PLUS ENERGY ELECTRIC VEHICLES CHARGING STATIONS L.L.C. registered in Dubai, UAE, with company number 1342622 and/or its affiliates, officers or directors, Group subsidiaries, employees, agents and assignees (referred to herein as “Plus X”, “we”, “us”, “our” or “the Company”), provides an App and associated Services via our App or web platform.

Welcome to the Plus X Electric mobile application ("App") and website ("Site"). By accessing or using our App and Site (collectively, the "Services"), you agree to comply with and be bound by the following terms and conditions ("Terms"). Please read these Terms carefully before using our Services. If you do not agree with these Terms, please refrain from using our Services.

Acceptance of Terms

By using the Services, you agree to these Terms and any modifications made to them from time to time. We may update these Terms periodically, and it is your responsibility to review them regularly. Continued use of the Services following any changes constitutes your acceptance of those changes.

Use of the Services

You agree to use the Services only for lawful purposes. You may not use the Services in any way that could damage, disable, overburden, or impair the Services or interfere with any other party's use and enjoyment of the Services. Each service run by Plus X will have its own set of T&C’s related to that specific service.

Account Registration

To access certain features of the Services, you may need to register for an account. You agree to provide accurate, complete, and up-to-date information during the registration process and to keep this information current. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account..

Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, which is incorporated into these Terms by reference, explains how we collect, use, and protect your personal information when you use our Services. By using the Services, you agree to the collection, use, and sharing of your information as described in our Privacy Policy. We comply with the General Data Protection Regulation (GDPR) and other applicable data protection laws.

Intellectual Property Rights

All content, design, text, graphics, logos, icons, images, software, and other materials on the Services ("Content") are the property of Plus X Electric or its content suppliers and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or in any way exploit any of the Content in whole or in part without our prior written consent.

Licence to Use the Services

We grant you a limited, non-exclusive, non-transferable, and revocable licence to access and use the Services for your personal, non-commercial use, subject to these Terms. This licence does not include any resale or commercial use of the Services or its Content.

User-Generated Content

If you submit any content to the Services (e.g., reviews, comments, or other materials), you grant Plus X Electric a worldwide, non-exclusive, royalty-free, perpetual, and irrevocable licence to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You represent and warrant that any content you submit does not infringe any third party's intellectual property rights or violate any laws.

Data Protection and GDPR Compliance

We are committed to protecting your personal data and ensuring compliance with the GDPR and other applicable data protection laws. You have the right to access, correct, delete your personal data, and restrict or object to its processing. Please refer to our Privacy Policy for more information on your rights and how we process your data.

Third-Party Services

The Services may contain links to third-party websites, applications, or services that are not owned or controlled by Plus X Electric. We are not responsible for the content, privacy policies, or practices of any third-party websites, applications, or services. Service Availability and Changes

We strive to provide reliable and uninterrupted access to our Services, but we do not guarantee that the Services will be available at all times or without interruptions. We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

Disclaimers and Limitation of Liability

The Services and their Content are provided "as is" without any warranties of any kind, either express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Plus X Electric does not warrant that the Services will be uninterrupted, error-free, or free of viruses or other harmful components.

In no event shall Plus X Electric, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, arising out of or in connection with your use of the Services.

Indemnification

You agree to indemnify, defend, and hold harmless Plus X Electric, its officers, directors, employees, agents, and affiliates from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or in any way connected with your use of the Services or your violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts located within the United Arab Emirates for the resolution of any disputes arising out of or relating to these Terms or your use of the Services

Termination

We reserve the right, in our sole discretion, to terminate or suspend your access to the Services, without notice, for any reason, including without limitation, breach of these Terms.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Portable Charging POD Service

Thank you for choosing Plus X Electric’s Portable Charging Pod service ("Service"). By booking and using our Service, you agree to comply with and be bound by the following terms and conditions ("Terms"). Please read these Terms carefully. If you do not agree with these Terms, you should not use our Service.

Service Description

The Portable Charging Pod ("Pod") is a mobile EV charging solution that delivers up to 50KW of power within a maximum of 6 hours. This service includes the delivery, setup, and pick-up of the Pod.s

Charging Performance

  • Power Delivery: The Pod is designed to deliver up to 50KW of power over a maximum period of 6 hours
  • Variability: We cannot guarantee a s pecific percentage of charge or charging time as these factors depend on several variables, including but not limited to:
    • Ambient temperature
    • Vehicle battery size and condition
    • Maximum charge intake of the vehicle
    • Vehicle-specific software settings which we may not have access to or control over.

Service Pricing

  • One-Off Charge: The cost for a single charging session is AED 120. This price includes delivery, setup, and pick-up of the Pod.
  • Subscription Model: We offer a subscription plan at AED 750 per month, which includes up to 8 charging sessions. Any unused charging sessions do not roll over to the following month.

Booking and Cancellations

  • Booking: Charging sessions must be booked in advance through our App or website. Availability is subject to demand and scheduling.
  • Cancellations: You may cancel your booking up to 2 hours before the scheduled delivery of the Pod without incurring any fees. Cancellations made less than 2 hours before delivery may incur a cancellation fee of AED 50.

Refunds and Service Guarantee

  • Refunds: If, for any reason, we are unable to charge your vehicle due to a Pod malfunction, we will issue a full refund for that session.
  • Service Level Agreement (SLA): We commit to delivering the Pod and starting the charging process within the scheduled time window agreed upon during booking. If we fail to do so, you will be eligible for a partial refund or a complimentary future charging session, depending on the circumstances.

Liability and Disclaimers

  • Limitation of Liability: If, for any reason, we are unable to charge your vehicle due to a Pod malfunction, we will issue a full refund for that session.
  • Vehicle Compatibility: We commit to delivering the Pod and starting the charging process within the scheduled time window agreed upon during booking. If we fail to do so, you will be eligible for a partial refund or a complimentary future charging session, depending on the circumstances.
  • Force Majeure: We are not liable for any failure to perform our obligations under these Terms due to causes beyond our reasonable control, including but not limited to natural disasters, war, strikes, and other unforeseeable events.

Customer Responsibilities

  • Access and Safety: You are responsible for ensuring that our team has safe and unhindered access to your vehicle at the time of the scheduled charging session. Any pets should be secured, and any obstacles removed from the charging area.
  • Vehicle Condition: Your vehicle must be in a condition that allows for safe and effective charging. This includes ensuring that the vehicle is parked in a safe location and that all vehicle systems are functioning properly.

Termination of Service

We reserve the right to terminate or suspend your access to the Service if you breach any of these Terms or engage in any conduct that we determine to be inappropriate or harmful to others

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United Arab Emirates. Any disputes arising from these Terms or your use of the Service shall be resolved by the courts located in the United Arab Emirates.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Valet Charging Service

Thank you for choosing Plus X Electric’s Valet Charging Service ("Service"). By booking and using our Service, you agree to comply with and be bound by the following terms and conditions ("Terms"). Please read these Terms carefully. If you do not agree with these Terms, you should not use our Service.

Service Description

The Valet Charging Service is currently available exclusively for Tesla vehicles. We will expand to include more vehicle brands in the near future. Our Service involves a Plus X Electric driver picking up your vehicle, charging it to 80%, and returning it within 3 hours.

Driver Qualifications & Insurance Criteria

All Plus X Electric drivers have valid UAE driving licences. However, Plus X Electric does not carry its own insurance for this Service. Our drivers are authorised to drive any insured vehicle that is owned and insured privately. The Service is not available for leased or rented vehicles unless the driver is added to the rental agreement to ensure coverage by insurance.

Driver Identification and Vehicle Condition Documentation

  • Driver Identification: All Plus X Electric drivers can be identified by their official Plus X badge. Before handing over your vehicle, you should validate the driver’s identity by checking their badge.
  • Check-In and Check-Out Process: Our drivers will take you through a check-in process before taking possession of your vehicle and a check-out process upon returning it. This process includes documenting the condition of your vehicle, including photos and/or videos. This documentation will be shared with you.

Liability and Insurance

  • Accidents and Insurance Coverage: If our driver is at fault in an accident, or if an accident occurs involving an unknown third party, Plus X Electric will cover any insurance excess fees that apply, upon submission of an invoice to our finance team.
  • Insurance Requirements: It is your responsibility to ensure that your vehicle is adequately insured. Plus X Electric is not responsible for any damage or loss that is not covered by your insurance policy.
  • FInes & Salik: Any fines whilst the Your vehicle is in our possession will be fully covered by Plus X. Salik will be Your responsibility.
  • Smoking: Our drivers will not smoke inside the Vehicle and Plus X will cover valet cleaning charges of up to AED 150 in case of this.

Service Level Agreement (SLA)

  • Guaranteed Turnaround: We guarantee that your vehicle will be picked up, charged to 80%, and returned within 3 hours. This SLA is based on normal traffic and operating conditions.
  • Partial Refund: If we fail to meet the 3-hour SLA, you will be eligible for a partial refund. The amount of the refund will be determined based on the extent of the delay and communicated to you promptly.

Service Availability

This Service is currently available only for Tesla vehicles. We plan to expand our Service to include more brands in the near future. Service availability may vary based on location, demand, and other operational factors

Booking and Cancellations

  • Booking: Charging sessions must be booked in advance through our App or website. Availability is subject to demand and scheduling.
  • Pricing: The Service is charged at AED 79 & any applicable charging cost, if any, will be added to this amount.
  • Cancellations: You may cancel your booking up to 2 hours before the scheduled pick-up time without incurring any fees. Cancellations made less than 2 hours before the scheduled pick-up time may incur a cancellation fee of AED 50.

Customer Responsibilities

  • Vehicle Access: You are responsible for ensuring that our driver has safe and unhindered access to your vehicle at the time of the scheduled pick-up. Any pets should be secured, and any obstacles removed from the vicinity of the vehicle.
  • Vehicle Condition: Your vehicle must be in a condition that allows for safe and effective charging and driving. Plus X Electric is not responsible for any issues that arise due to pre-existing vehicle conditions.

Limitation of Liability

Plus X Electric shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, arising out of or in connection with your use of the Service.
